Total liability is limited to the greater of $100 or your total payments to Oasis Pouches in the last 12 months.

16. Dispute Resolution & Arbitration

Binding Arbitration. If we cannot resolve the dispute, both parties agree to binding arbitration administered by JAMS (Judicial Arbitration and Mediation Services) in Delaware, or virtually. Arbitration will be conducted on an individual basis. 

No class actions, class arbitrations, or jury trials are permitted.

Opt-Out. You may opt out of this arbitration agreement within 30 days of first agreeing to these Terms by emailing support@oasispouches.co with the subject line "Arbitration Opt-Out" and including your full name and account email address.

Governing Law. These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute not subject to arbitration shall be brought in the state or federal courts located in Delaware.

You agree to indemnify, defend, and hold harmless Oasis Pouches, Shopify, and our affiliates, partners, officers, directors, employees, agents, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
